MOI Companion - Terms of Service

Welcome to MOI Companion. These Terms of Service ("Terms") govern your use of the MOI Companion app and SMS service (the "Service") provided by Mother of Invention ("MOI," "we," "our," or "us").

By signing up for MOI Companion, you agree to these Terms. If you don't agree, please don't use the Service.

1. What MOI Companion Is

MOI Companion is a pregnancy wellness app that provides:
•Weekly educational content about fetal development and attachment
•Guided mindfulness practices for connecting with your baby
•AI-powered conversational support
•SMS delivery of content and reminders

The Service is designed to support emotional and relational aspects of pregnancy. It is not medical advice and should not replace care from qualified healthcare providers.

2. Eligibility

You must be:
•At least 18 years old
•Pregnant or planning to become pregnant or have a baby
•Able to receive SMS messages in the United States

We reserve the right to refuse service to anyone for any reason.

3. Your Account

Creating an Account:You provide your phone number and pregnancy informationWe send you a magic link via SMS for secure accessYou're responsible for keeping your phone secureAccount Security:Your phone number is your login credentialDon't share your magic link with othersNotify us immediately if you lose access: hello@motherofinvention.comAccount Information:You agree to provide accurate informationYou can update your pregnancy week and other details in app settingsYou can delete your account at any time

4. SMS Messaging Terms

Consent to Receive Messages:By signing up, you consent to receive text messages from MOI Companion including:Weekly pregnancy wellness content (1-2 messages per week)Practice reminders and reflectionsAccount notifications (magic links, confirmations)Occasional promotional messages about Mother of Invention products and events (2-3 per month maximum)Message Frequency: Varies. 5. How You Can Use the Service

Permitted Use:Personal, non-commercial use during your pregnancyEngaging with content and practices as intendedAsking questions and sharing reflections with the AI CompanionProhibited Use:You agree NOT to:Use the Service for medical diagnosis or treatment decisionsShare or distribute content from the app without permissionAttempt to reverse-engineer, hack, or disrupt the ServiceUse the Service to harm, harass, or deceive othersImpersonate another person or provide false informationUse automated tools (bots, scrapers) to access the ServiceCopy, reproduce, or resell any part of the ServiceViolation of these terms may result in immediate suspension or termination of your account.

6. Intellectual Property

MOI's Content:All content (text, practices, visuals, code) is owned by Mother of Invention or our licensorsYou may not copy, modify, distribute, or create derivative works without permissionThe MOI logo, name, and trademarks belong to Mother of InventionYour Content:You own the reflections and messages you create in the appBy using the Service, you grant us a limited license to:Store and display your reflections for your personal useUse anonymized data to improve the ServiceAnalyze usage patterns for research and developmentWe will never:Publicly share your personal reflections without consentSell your data or content to third partiesUse your messages to train AI models (per OpenAI's API terms)

6. Children’s Privacy

Our site and waitlist are not intended for children under 13. We do not knowingly collect personal information from children.

7. AI Companion & Content Disclaimers

AI Limitations:The AI Companion uses OpenAI's GPT-4 technologyResponses are generated based on patterns, not human judgmentAI can make mistakes, provide incomplete information, or misunderstand contextAlways verify important information with qualified professionalsNot Medical Advice:MOI Companion provides educational and emotional support onlyIt is NOT a substitute for medical careWe do not diagnose, treat, or prevent any medical conditionsAlways consult your doctor, midwife, or healthcare provider for:Medical symptoms or concernsChanges in fetal movementHigh-risk pregnancy conditionsMental health concerns requiring clinical supportEmergency Situations:If you're experiencing a medical emergency, call 911 immediatelyFor mental health crises, contact the National Maternal Mental Health Hotline: 1-833-943-5746Content Accuracy:We strive for scientific accuracy but cannot guarantee error-free contentPregnancy experiences vary; our content may not apply to all situationsIf something doesn't feel right, trust your instincts and seek professional care

8. User Generated Content

Your Reflections:Are private by defaultCan be viewed only by you in your accountMay be anonymized and aggregated for research (no personal identifiers)Community Features (Future):If we add sharing or community features, we'll update these TermsYou'll have control over what you share publiclyProhibited Content:In any reflections, messages, or future community features, you agree not to post:Hateful, abusive, or discriminatory contentSpam, advertising, or solicitationsContent that violates others' privacy or intellectual propertyExplicit sexual content or pornographyMedical misinformation or dangerous health adviceAnything illegal or harmfulWe reserve the right to remove content and suspend accounts that violate these rules.

9. Privacy & Data Use

Your privacy is important to us. 10. Third-Party Services

MOI Companion integrates with:Twilio - SMS message deliveryOpenAI - AI conversational supportSupabase/Loveable Cloud - Secure data storageThese services have their own terms and privacy policies. By using MOI Companion, you also agree to their terms. We are not responsible for their services, but we carefully vet our partners.

11. Fees

Free Service:MOI Companion is currently free to useSMS messages are free (carrier charges may apply)Future Paid Features:If we introduce paid features or subscriptions, we'll notify youPricing and terms will be clearly disclosed before purchaseYou'll always have the option to continue using free featuresPromotional Messages:You may receive messages about Mother of Invention productsThese may include special offers or early access opportunitiesWe will never spam you or send excessive promotional messagesYou can opt out of promotions while staying subscribed to weekly content (coming soon)

12. Changes to Service

We're constantly improving MOI Companion. We may:Add new features or contentUpdate existing featuresRemove features that aren't working wellChange pricing (with notice)We'll do our best to notify you of significant changes via SMS or email.

13. Termination

You Can Leave Anytime:Reply STOP to opt out of messagesDelete your account in app settingsEmail hello@motherofinvention.com to request full deletionWe Can Suspend or Terminate:If you violate these TermsIf you use the Service in ways that harm others or our systemsIf required by lawIf we discontinue the Service (we'll give notice when possible)After Termination:You'll stop receiving messages immediatelyYour data will be deleted per our Privacy PolicyYou may no longer access the Service

14. Disclaimers and Limitations

SERVICE PROVIDED "AS IS":TO THE FULLEST EXTENT PERMITTED BY LAW, MOI COMPANION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.WE DO NOT WARRANT THAT:The Service will be uninterrupted or error-freeContent will be accurate, complete, or up-to-dateDefects will be correctedThe Service is free from viruses or harmful componentsLIMITATION OF LIABILITY:TO THE FULLEST EXTENT PERMITTED BY LAW, MOTHER OF INVENTION SHALL NOT BE LIABLE FOR:Any indirect, incidental, special, or consequential damagesLoss of profits, data, or goodwillDamages arising from use or inability to use the ServiceMedical outcomes, pregnancy complications, or health issuesDecisions made based on Service contentOUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (CURRENTLY $0), WHICHEVER IS GREATER.Essential Health Disclaimer:YOU ACKNOWLEDGE THAT:MOI Companion is not medical careYou are solely responsible for your health decisionsYou will consult qualified healthcare providers for medical adviceWe are not liable for any health outcomes related to pregnancy

15. Dispute Resolution

Informal Resolution:If you have a problem with the Service, please contact us first: hello@motherofinvention.com. We'll work with you to resolve issues.Governing Law:These Terms are governed by the laws of the State of California, without regard to conflict of law principles.Arbitration:Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. Arbitration will take place in Los Angeles, California.Class Action Waiver:You agree to resolve disputes individually, not as part of a class action or representative proceeding.Small Claims Court:You may bring claims in small claims court if they qualify and remain in small claims court.

16. Indemnification

You agree to indemnify, defend, and hold harmless Mother of Invention, its officers, directors, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:Your use of the ServiceYour violation of these TermsYour violation of any third-party rightsContent you submit or share through the Service

17. General Terms

Entire Agreement:These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mother of Invention regarding the Service.Severability:If any provision of these Terms is found invalid, the remaining provisions remain in full effect.No Waiver:Our failure to enforce any right or provision doesn't waive that right.Assignment:You cannot transfer your rights under these Terms. We may assign our rights to affiliates or in connection with a merger or sale.Changes to Terms:We may update these Terms from time to time. Significant changes will be communicated via SMS or email.
